First, a completely independent review board has found that Skechers has substantiated the claims that Shape-ups tone muscles, improve posture and promote weight loss. This was the second time in recent months that Skechers received a favorable ruling about Shape-ups claims from an independent board.

Second, we also want to share the fantastic news that the United States Patent Office this week issued Skechers a patent on its unique Shape-ups midsole technology, recognizing as novel the part of the shoe which provides the fitness benefits to users.

Third, we are very excited to announce and move forward with introducing a new unilateral pricing strategy for Shape-ups, Tone-ups, and our Resistance categories. As you know, together with your support as valued customers of Shape-ups, Skechers established a consistent and respected price in the market place through the mandatory minimum retail pricing (MMRP) strategy announced last year. The momentum of Shape-ups has propelled Skechers to continue to innovate within the toning category.  Along with this product innovation and further development of the category, further innovation in the way we sell the category must also occur to maintain a respected image in the marketplace. With that in mind, we now feel the time is right to move from the current MMRP policy to a unilateral Minimum Advertised Price policy or (MAP).  Please see the attached MAP policy. This MAP policy takes effect immediately and all previous pricing policies, including the previous MMRP announced in July 2009, are hereby revoked.
